Strengthening Security Through Investment Scrutiny

Greece has adopted Law 5202/2025, establishing a formal screening mechanism for foreign direct investments (FDIs) in alignment with EU Regulation 2019/452. The new law aims to protect national security and public order by scrutinizing investments in sensitive sectors such as energy, transport, defense, and cybersecurity.
Screening is triggered when non-EU investors, or EU entities under foreign control, acquire stakes in strategic industries. Thresholds start at 10% for highly sensitive sectors. Exclusions apply to passive investments and intra-group restructurings.
A dedicated interministerial committee oversees the process, with the Ministry of Foreign Affairs issuing final decisions. Non-compliance may result in fines, reversal of transactions, or further penalties.
This marks a significant shift toward risk-based investment oversight in Greece, combining openness with strategic safeguards.
