EU Insolvency Directive

EU Insolvency Directive

The EU has adopted Directive (EU) 2026/799, introducing reforms to harmonise key aspects of insolvency law across Member States. The new framework covers pre-pack proceedings, directors’ duties, asset tracing and recovery, access to financial and beneficial ownership information, and creditors’ committees. The reforms are expected to affect restructurings and distressed M&A transactions by supporting faster sale processes, improved value preservation and greater consistency across the EU.
