The Council of State, through processing minutes 135/2025, confirmed the legality of the draft presidential decree introducing an environmental equivalent mechanism under Law 5197/2025, following earlier rulings on the unconstitutionality of the New Building Regulation (NOK) incentive system. The mechanism allows the re-issuance of affected building permits under a new framework with environmental pre-assessment and equivalent compensation measures. The Council also clarified that only authorised aerial photographs may serve as proof of construction commencement before 11 December 2024.
