The European Commission has published the draft revised Technology Transfer Block Exemption Regulation (TTBER) and Guidelines, introducing updates on data licensing, technology pools, and market share thresholds. While thresholds remain unchanged, grace periods are extended, safe-harbour conditions clarified, and new guidance provided on licensing negotiation groups. The reform aims to modernise EU competition rules for a data-driven economy while ensuring predictability in technology licensing and R&D cooperation. Businesses are advised to review contracts, assess data exposure, and evaluate participation in pools or negotiation groups ahead of the consultation deadline on 23 October 2025.
